The Economic and Social Council is a public institution of national interest, tripartite, autonomous, established for the purpose of realizing tripartite dialogue at the national level between employers' organizations, trade unions and representatives of non-governmental associations and foundations of civil society (Law no. 248/2013).

The Romanian Constitution defines the Economic and Social Council (ESC) as an advisory body of the Parliament and the Government in the specialized fields established by its organic law of establishment, organization and operation.
